BOOKING TERMS & CONDITIONS

​

Please ensure that you have thoroughly read through the Experience Travel Pty Ltd terms and conditions. You are unable to book any holiday with us unless you have read through and accepted the terms and conditions. References to 'us', 'our' and/or 'we' in the below booking terms and conditions means Experience Travel Pty Ltd.

These terms and conditions refer to bookings made by you with our travel representatives (via email, phone or in person) as well as anything directly booked on our agency website.   

​

Experience Travel and any agent working on their behalf will assume that the person making the booking is doing so on behalf of the traveling party and all persons are bound by the terms and conditions of the booking.

PASSPORTS & VISA’s 

​

All travelers booking an international holiday must have a valid passport with at least 6-months validity from the scheduled arrival date back into the country and many countries require passports to be machine readable. When assisting with a booking, Experience Travel agents or any party acting on our behalf will assume that all clients on the booking have a valid Australian Passport. If there are any parties on the booking that don’t have a valid passport then they need to declare as such to the agent. It is imperative that you the client ensures that all passports are valid, visas and relevant re-entry permits which meet the requirements of immigration and other governing authorities. Any litigation, detaining, fines and varying expenditure incurred as a result of the mentioned documentation not meeting the requirements of those authorities will be your sole responsibility and Experience Travel takes no responsibility. Please let our agent’s know if you require advise on Visa or Passport arrangements. Our agent’s can provide general advice about passport and visa requirements on the bookings that are made with us. Experience Travel can’t guarantee the validity of the visa advise given by a third party or external service and accept no responsibility for and financial loss or inconvenience caused as a result of reliance on it.

USA Entry – Please refer to https://esta.cbp.dhs.gov/ for all information regarding their strict policy in obtaining a visa waiver ‘ESTA’ Australian Passport holders will not be able to enter the United States without a valid ‘ESTA’ or Pre-Obtained Entry Visa. It is essential that clients are aware that they may not be eligible to qualify for an ‘ESTA’ and an entry visa will need to be applied for instead.

TRAVEL ADVICE:

We recommend that all of our clients contact the Department of Foreign Affairs and Travel or visit their website to www.smarttraveller.gov.au for general advice and to register their travel in the event of an emergency. This website can also be used for specific advice such as travel warnings and other alerts directly related to the destination you’re visiting.

​

HEALTH:

All travelers must be aware of any health requirements of the country they’re traveling to as well as recommended precautions required to take. Vaccination advice can be provided by a doctor and specific documentation can also be issued. In some case’s failure to provide documentation of specific vaccinations (Such as Yellow Fever injection) can result in refusal of entry to specific countries. We recommend that you consult with your local doctor, medical travel specialist or vaccination clinic prior to departure. DFAT also provides general health advise for the visiting country.

TRAVEL INSURANCE:

Experience Travel highly in conjunction with the Department of Foreign Affairs and Trade (DFAT) recommends that travel insurance is taken out by all travelers regardless of the destination. It is important that the travel insurance covers you for medical, repatriation expenses as well as cancellation, personal, accidental injury, loss and damage cover and personal liability insurance. Many credit cards offer insurance cover as a part of their deals however most are not fully comprehensive. Experience Travel takes no responsibility for any loss or damage that may occur from a result of a client taking out insurance with an independent provider. Your Experience Travel consultant can provide you with information about travel insurance and recommend products that meet your need. Please request a product services guide from your consultant if you require further information. Clients must thoroughly read through the insurance terms and conditions and the financial services guide/product disclosure statement before deciding on purchasing travel insurance to ensure that it meets their requirements.You may be asked by your consultant to sign a waiver if you decide to purchase a holiday through Experience Travel but decline insurance.

FREQUENT FLYER:

Please advise your membership details for inclusion in your booking. Ensure you check your loyalty program for the specific terms of your membership. We cannot guarantee that the supplier will credit you with points for your booking however we will enter your details in the flight booking engine.

PRICES:

All prices for holidays are subject to change until booking is paid in full and up until then can be withdrawn without notice. The price is only guaranteed once paid in full and money is cleared in Experience Travel’s company bank account. Please note that some payment methods take longer to clear and will need to be considered. Prices quoted are subject to change. Price changes can occur regularly and through reasons outside our control which can increase the cost of service or product. Factors that may impact fluctuation in costing can include currency fluctuations, tax and airfare increases, or selling out of a particular product or cabin class. Please get in touch with your consultant for up to date pricing. Airline taxes are subject to change and are confirmed at the time your airline ticket is issued. There may also be a local tax charged at some airports.

DEPOSITS & FINAL PAYMENTS:

A deposit will be required to hold any holiday booking with final payment due on the specified date. Deposits vary depending on the size of the booking and requirements of the wholesaler. All deposits are non-refundable including but not limited to changes of mind or cancellations by you (subject to your rights under the Australian Consumer Law). All payments are due in full no later than six weeks prior to travel. Payments can be made via a secure portal link on the book & pay page.

PAYMENTS BY CREDIT CARD & DEBIT CARD:

Credit & Debit Card surcharges of 1.2% for both Visa & Mastercard will apply when paying by card. For Premium or Corporate Visa & Mastercard surcharges of 1.95% will apply.

AMEX card surcharges of 1.95% will apply when paying by AMEX.

When charging your card, you accept and authorise Experience Travel to charge any of these fees to you on the payment of bookings made by you with one of our representatives. If payment is not received from the card issuer for any reason then you authorise us to charge you this amount immediately. Payments can be made via a secure portal link on the book & pay page.

PAYMENTS MADE BY CHEQUE:

Please note that cheques can take up to 5 days to clear in our bank account and this needs to be considered in order to adhere to the due by date. You the client agree to not cancel the cheque up request to cancel the booking. You agree that we may use the proceeds of the cheque towards any liability that you have to us including cancellations fees prior to the return of funds back to you.

MONIES ARE NOT HELD IN A TRUST:

All monies from payments made by you to us will be the exclusive property of Experience Travel PTY LTD. Such monies will not be held on trust for and on behalf of you and you agree for us to hold such monies in an account of our choosing, including with our own and/or other customer payments.

SUPPLIER CHANGE AND CANCELLATION FEES:

In addition to cancellation fees from Experience Travel, cancelled bookings may also incur supplier fees which can be up to 100% of the booking depending on scheduled departure date and restrictive sale periods. Supplier fees also occur when a booking date is re-altered and new documentation is required. In the event you (the client) cancelling a booking, any refunds will not be transferred to you until funds from the supplier clears in Experience Travel Pty Ltd's account. Experience Travel Pty Ltd takes no responsibility or liability for any change or cancellation fees incurred through customer action.

DOCUMENTATION:

Please review your final travel documentation meticulously and advise us immediately of any errors in names, dates or timings. Generally your travel documents will be emailed or sent out to you approximately 2-3 weeks prior to departure, however this will depend on your bookings and the travel providers involved.

TIME CHANGES & TRIP PLANS APP (INCLUDING AUTO FLIGHT UPDATES):

Whilst the Trip Plan app does begin to update times of flights within 24 hours of departure it is reliant on 3rd Parties such as Airlines and websites correctly updating their data, and also having your device connected to the internet and actively opening the Trip Plans App. We take absolutely no liability nor responsibility for the accuracy of auto-updated information provided by the application. We strongly recommend that you contact the airline via the internet or phone to confirm your scheduled departure time 24 hours prior to your flight.

LIABILITY & 3RD PARTY PROVIDERS: 

Within the scope of the law, Experience Travel PTY LTD (and any of its related parties, directors, employees or agents) will not accept any liability in contract (tort or otherwise) for any inconvenience,  delay, additional expense, injury, damage, loss or consequential loss caused directly or indirectly by the actions, events, or oversights (whether intentional or not) of parties for which we have no direct control. The same applies to force majeure or any other situations which are beyond our control, which could have been prevented with reasonable diligence from us. In certain cases where our liability cannot be excluded and where liability may be limited by law, such liability is limited to the obligations required of us under applicable law, subject to your rights under the Australian Consumer Law  and the Competition and Consumer Act 2010 (Cth). We are an agent and sell various travel products on behalf of numerous travel providers including but not limited to Airlines, Transport Providers, Tour Operators, Cruise Lines, Hoteliers and a variety of wholesalers. The services we provide to you are compiling, recommendations, contract arrangements and booking your travel on your behalf of you using products operated by these entities. We do NOT operate travel products/services such as the aforementioned and have no control over or liability for the services they provide. Any restrictions, limitations of liability and conditions imposed by these entities are accepted by you. Relevant terms & conditions of these 3rd parties can be provided upon request however are generally in your Experience Travel PTY LTD invoice. Should any of these 3rd parties cause issue (legal or otherwise) or is unable to provide the contracted service your legal rights stand in connection with you and the specific provider and not Experience Travel PTY LTD.

GOVERNING LAWS:

If a dispute occurs between you (the client) and Experience Travel PTY LTD, the laws of Australia will apply. You agree unconditionally and irrevocably to the application and exclusive jurisdiction of the courts of Australia.
